JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report that a quarrel took place between the parties on a petty issue and in that quarrel, petitioners assaulted the informant with fist and slaps. The informant's brother and other relatives came to his rescue but the aforesaid persons were assaulted by other FIR named accused. In course of treatment, one injured, namely, Suresh Yadav died but according to prosecution case itself, petitioners were unarmed at the time of alleged occurrence, which would appear from the FIR itself, in which, the informant himself stated that initially, he was assaulted by petitioners with fist and

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Shambhuganj P.S. Case No. 69 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka.
