JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-03-2022 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no. 1 Amar Kumar, since during the pendency of this application he has been arrested.

Permission is accorded.

Accordingly, the application of petitioner no. 1 Amar Kumar is dismissed as withdrawn.

Heard learned counsel for the petitioner nos. 2 and 3 and the learned A.P.P. for the State.

The petitioners apprehend arrest in connection with

Patna High Court CR. MISC. No.57751 of 2021(5) dt.02-03-2022 2/2 Gogari P.S. Case No. 96 of 2021 registered under Sections 467, 468, 471, 420 and 120(B)/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case with a view to grab the land. Further he submits that the alleged dispute is civil in nature. Petitioners have no criminal antecedent.

Having considered the above facts and circumstances of the case, let the above named petitioner nos. 2 and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of C.J.M., Khagaria in connection with Gogari P.S. Case No. 96 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
