The petitioner has been arrested in connection with Ahiyapur P.S. Case No. 749 of 2013 registered for offence under Section 414 of the Indian Penal Code as well as Sections 25(1-b)a, 26(ii) and 35 of the Arms Act.

Learned counsel for the petitioner submits that one pistol has been recovered from waist of the petitioner and no other material has been recovered from the possession of the petitioner. The petitioner is in jail custody since 24.10.2013 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 749 of 2013, subject to condition that petitioner will not indulge in such activity in future.
