JUSTICE SHIVAJI PANDEY ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned counsel for the State.

This application has been filed to modify the order dated 19.04.2016 passed in Criminal Miscellaneous No.7748 of 2016.

Earlier, this Court has granted bail to the petitioner vide order dated 19.04.2016, but he could not comply the terms and conditions what he has agreed while getting the order of the bail and on that account he could not come out from the jail custody. This Court has also granted provisional bail to the petitioner for certain period, even then he could not arrange the money what he was required to deposit.

In such view of the matter, this Court does not find

Patna High Court Cr.Misc. No.38491 of 2016 (5) dt.11-01-2017 2/2 any purpose and merit to extend the benefit to the petitioner. Accordingly, this Modification Application is dismissed. However, the Court below is directed to expedite the trial and conclude the same as early as possible.
