The petitioners seek bail in Bidupur P.S. Case No. 288/08 registered for the offence under Section 304(B) and other sections of the Indian Penal Code.
The informant, father of the deceased made allegation that his daughter Shobha Kumari was married to one Surajbhan, son of Jawahar Prasad on 21.07.2007, but thereafter her husband, father-in-law, mother-in-law, brother-in-law and sister-in-law subjected her to all sorts of torture and she was killed on 27.12.2008.
It is submitted that petitioners are mother-in-law and brother-in-law of the deceased. The father-in-law of the deceased has already been granted regular bail by the Learned Sessions
Patna High Court Cr.Misc. No.5191 of 2015 (3) dt.24-03-2015 2/2 Judge vide order dated 10.02.2009.
It appears that the daughter of the informant was done to death within one and half years of her marriage and injury was found on the dead body of the deceased. Dead body of the deceased was also found burnt. Father-in-law of the deceased has already been enlarged on bail. The case of the petitioners stand on the same footing.
Considering the facts aforesaid, the petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 288/08.
