This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for anticipatory bail by the learned 1st Additional Sessions Judge, Nalanda, in Rajgir SC/ST Police Station Case No.98 of 2015 registered under Sections 341/323/504/506/427/34 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The F.I.R. prima facie discloses offence said to have committed under the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Therefore,
Patna High Court CR. APP (SJ) No.33 of 2018 (4) dt.09-02-2018 P2/ bar under Section 18 of the Act to entertain anticipatory bail application is applicable.
Accordingly, I do not find any merit in this appeal. Hence, it stands dismissed.
