The petitioner seeks pre-arrest bail in connection with Udwant Nagar P.S. Case No. 59 of 2016 registered under Sections 420, 467, 468 and 471 / 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner was posted as Head Mistress of the C.G. High School, Belaur, Bhojpur and the accused no.2 was admitted in the High School on the basis of the School Leaving Certificate issued from the Middle School, Belaur, Bhojpur and the admission certificate was issued accordingly. He submitted that the
Patna High Court Cr.Misc. No.58675 of 2017 (2) dt.12-12-2017 co-accused Binod Choudhary and Ashutosh Choudhary had forged and fabricated the school leaving certificate and obtained the same by committing forgery, which was not in the knowledge of the petitioner, who issued the admission certificate as per the record and nothing as alleged has been done by the petitioner intentionally.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Considering the allegations made in the first information report and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwant Nagar P.S. Case No. 59 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
