2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 109, 303 (2), 352, 3 (5) of the BNS and Section 25 (1-B), 26 27 and 35 of the Arms Act.

3. The case of the prosecution is that the petitioner along with others arrived at the house of the informant. It is alleged that Chandradeo Yadav and Manohar Yadav started firing indiscriminately which hit the right leg of Ranju Devi as a result of which, he fell down. It is further alleged that the petitioner and one Amit Kumar also fired. The fire went near the temple of Ranju Devi and has also torn the saree.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.48501 of 2025(2) dt.08-08-2025 2/2 connection with the present case. It is further submitted that though there is allegation of firing against him but the Fire which has been made did not not hit anybody rather it has touched only the saree. Moreover, the petitioner is languishing in judicial custody since 30.04.2025.

5. Learned counsel for the informant has opposed the prayer of regular bail stating that due to the gun shot injury, the right leg of Ranju Devi has to be mutated. From perusal of the FIR itself, it is clear that the fire which has been made by this petitioner has not hit Ranju Devi. The specific allegation is against Chandradeo Yadav and Manohar Yadav. Further submission is that the petitioner has one criminal antecedent.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khagaria (Gangaur) P.S. Case No. 22 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria.
