JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-11-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Complaint Case No. 1472 of 2014, disclosing offences under Sections 467, 468, 471, 406 and 120-B of the Indian Penal Code.

Learned counsel for the petitioners has submitted the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the college in question is private college and is being run by the Management Committee in which Chairman and Secretary along with the

No.51928 of 2017 (2) dt.09-11-2017 Principal of said college are members and according to their recommendations the petitioner has completed the construction work in the college and respective voucher with respect to expenditure have also been submitted by the petitioner before the Committee. Not a single farthing has been misappropriated by these petitioners. Moreover, the Principal of the said college having more or less similar allegations has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 49007 of 2017. Hence, the petitioners deserve the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Complaint Case No. 1472 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
