JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Petitioner is languishing in custody since 18.06.2014 in a case registered for the offences punishable under Sections 414, 420 of the I.P.C, Section 25(1-B)a, 26, 35 of the Arms Act and Section 17 of the Criminal Law Amendment Act.
The police raided the house of Sri Narain Prasad on information that extremists have assembled there when six persons were apprehended and the apprehended accused disclosed that three persons including the petitioner escaped from the scene.
It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner and the investigation has already concluded. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.13207 of 2015 (2) dt.07-04-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Rajepur P.S. Case No. 42 of 2014. Since the petitioner is accused in three other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
