Petitioner was neither caught on the spot nor anything was recovered either from his conscious possession or from his house. The name of the petitioner came in this case in the confessional statement of co-accused Bhola Mian who was caught on the spot. The said co-accused Bhola Mian has already been granted privilege of bail.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Abhishek Kunal, Judicial Magistrate, Ist Class, Gopalganj/ concerned court in Hathua P.S. Case no. 135/2015.
