JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-05-2023 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant. The petitioners apprehend their arrest in connection with Hathaudi P.S. Case No. 122 of 2020 registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 354-B, 379, 504, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 8 of the POCSO Act.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to land dispute. Further

Patna High Court CR. MISC. No.47877 of 2022(5) dt.16-05-2023 2/2 submission is that there is case and counter case between the parties. Both the parties have sustained injuries in the alleged occurrence.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, Muzaffarpur in connection with Hathaudi P.S. Case No. 122 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
