2. The petitioners before this Court are Constables who have been discharging their duties in Bihar Special Armed

3/5 Police-16, which is a dying cadre battalion of BSAP. They were recruited to the post of Constable on 11.10.2010 through the same advertisement and selection process, meant for exservicemen.

3. It is submitted that the petitioners are subjected to disparities with the identically situated persons. Out of the 55 Constables appointed in the first batch, 25 Constables had completed their Senior Programme Course (SPC) training. However, due to the COVID-19 pandemic, the training programme was stopped and those who had completed the training, they were promoted to the post of Havildar and subsequently to the post of Sub Inspector of Police. However, the petitioners have been left out only on account of the fact that no training programme was convened for the petitioners. The State respondents have also come out with a letter dated 30.04.2026, whereby directions have again been issued for special training to batches of 36 Constables each. However, this time also the case of the petitioners has not been considered for such training.

4. For redressal of the grievance, the petitioners have also approached before the Deputy Inspector General of Police, Bihar Special Armed Police (Central Range), Patna; despite the

4/5 request and the representation pending since 11.05.2026, no favourable action has been taken, compelling the petitioner to approach this Court.

On the other hand, learned Advocate for the State submitted that since the petitioners have already approached before the authorities concerned, who is competent in the matter, it would be appropriate that if the concerned authorities shall consider the case of the petitioner in accordance with law.

Having considered the submissions advanced by the learned Advocate for the respective parties and upon perusal of the materials available on record, especially the fact that the petitioners have already approached before the Deputy Inspector General of Police, Bihar Special Armed Police (Central Range), Patna vide Annexure-P-6, copy of which has also been forwarded to the higher authorities, it would be apt and proper to dispose off the writ petition with a direction to the respondent no. 5 to consider the representation of the petitioner dated 11.05.2026 in the light of the averments made in the writ petition as well as the applicable rules preferably within a period of eight weeks from the date of receipt/production of a copy of this order by speaking and reasoned order.

7. With the aforesaid direction, the writ petition stands disposed.
