The petitioner is in custody for more than four and a half years in the case registered under Section 304B and 201/34 of the Indian Penal Code but up-till-now three prosecution witnesses could be examined.
The contention on behalf of the petitioner is that the cause of death of the deceased could not be ascertained by the Doctor, which is evident from perusal of Annexure-3 to this petition.
Considering the aforesaid facts and circumstances as well as the submissions of the parties and also keeping in mind the period of detention of the petitioner in custody, let the petitioner Ram Chandra Ram be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.16875 of 2015 (2) dt.15-04-2015 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, 1st. West Champaran, Bettiah, in connection with Sessions Trial No. 261 of 2011, corresponding to Bettiah (Muffasil) P.S.Case No. 301 of 2010.
