The petitioner renews his prayer for bail in connection with Gopalpur PS Case No. 189/2020 for the offences punishable under Section 392 IPC, inasmuch as earlier bail application of the petitioner was dismissed as withdrawn vide order dated 03.01.2022 passed in Cr. Misc. No. 49147/2021 with an observation that the petitioner may renew his prayer for bail after six months.

Allegation as per First Information Report is that four unknown persons accosted the driver of the informant and looted away his tractor bearing Registration No. BR22Q-4723. Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged and he has been made accused on the basis of his confessional statement made before the police and the stolen vehicle has not been recovered from his possession. Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is in custody since 22.01.2021, the charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, namely, JAHANGIR ANSARI @JAHANGIR ALAM be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-West Champaran, Bettiah in connection with Gopalpur PS Case No. 189/2020, subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
