JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Nautan (Jagdishpur) P.S. Case No. 227 of 2015, registered under Sections 363 and 366(A) of the Indian Penal Code. The accusation is of kidnapping of Sahima Khatoon, aged about 17 years, daughter of the informant, by this petitioner and others with bad intention.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the victim moved with this petitioner according to her sweet will and when she come to know about lodging of the F.I.R, she appeared before the Police Station on the very next day, thereafter, her statement was

Patna High Court Cr.Misc. No.2436 of 2016 (3) dt.15-03-2016 2/3 recorded in which she had stated about her kidnapping by this petitioner and one Farindra. In her statement, she further stated that Farindra mixed intoxicated material in the food of the victim and got separated both and thereafter, she was sold by Farindra and thereafter, he left her for Police Station giving threatening to not disclose his name. Further submission is that, in fact, there was love affairs in between the petitioner and the victim and victim herself left her house out of her sweet will to perform marriage with the petitioner. It is submitted that after giving the statement under Section 164 of Cr.P.C. making specific allegation to sell her by co-accused Farindra, she filed an application before the trial court admitting the real fact about moving with this petitioner according to her sweet will. The petitioner has no criminal antecedent and he is in custody since 16.10.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S. Case No. 227 of 2015. Out of two sureties, one surety must be the
