JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 26-09-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Bihar School Examination Board (hereinafter referred to as the 'Board').

2. The petitioner in the present case is seeking a writ in the nature of Mandamus directing the Board and its authorities to consider approving the Managing Committee and its Governing Body for smooth functioning of the College in question.

3. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.11730 of 2023(2) dt.26-09-2023 2/2 District Programme Officer, Secondary Education and Literacy, Siwan has vide his Letter No. 42 dated 02.02.2022 requested the Director (Education) of the Board to take appropriate action towards constitution of the Managing Committee and Governing Body of the College in question. A copy of the letter is Annexure '3' to the writ application. It is, however, the grievance of the petitioner that the matter is still pending with the Director (Education) of the Board.

Having regard to the aforementioned submissions, this Court directs the Director (Education) (Respondent No. 7) to consider Annexure '3' to the writ application, if require, hear the petitioner and pass an appropriate order in accordance with law within a period of two months from the date of receipt/communication of a copy of this order. 5.

This writ application stands disposed of accordingly.
