The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code, Section 27 of the Arms Act and Sections 3(i)(xiv), 3(i)(xi) of the S.C. and S.T. Act. Later on, Section 302 I.P.C. was added.
The petitioner is alleged to have ordered and, on such, Sunil Singh fired on the head of the wife of the informant, Meena Devi. It is submitted that the informant made statements under Section 164 of the Code of Criminal Procedure and did not say anything about the petitioner. He disclosed that when he turned towards his wife on hearing the sound of firing, he saw Sunil Singh fleeing away from the place of occurrence.
