The petitioner seeks bail in connection with Khajekalan P.S. Case No. 95 of 2021, Special Case No. 2535 of 2021 dated 28.03.2021 instituted for the offence under Section 414 of the Indian Penal Code, Section 25(1-b) A/26/35 of the Arms Act and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

31 litres of liquor and a live cartridge is said to have been recovered from the possession of the petitioner and another of his associate.

It has been submitted on behalf of the petitioner that he is in custody since 29.03.2021 and the other co-accused person of this case has been granted bail by a Bench of this

Patna High Court CR. MISC. No.58079 of 2021(2) dt.23-05-2022 2/2 Court.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Khajekalan P.S. Case No. 95 of 2021, Special Case No. 2535 of 2021. This Court has noticed that though the petitioner has been made accused in two other case of serious nature but in those cases he has been granted bail.
