ANJANA MISHRA ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 7.10.2015 in connection with Paharpur P.S. Case No. 278 of 2015, registered for offences punishable under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is not named in the F.I.R., his name has come on a confessional statement made by a co accused, namely, Rajesh Ram. It is further submitted that the petitioner is a tractor mechanic and has nothing to do with the said occurrence. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent and that subsequent to the present case on his having been taken into custody, the petitioner has also been

Patna High Court Cr.Misc. No.3672 of 2016 (2) dt.08-02-2016 2/2 remanded in one other case. He further submits that till date, no Test Identification Parade has been conducted. Considering the aforementioned facts and circumstances and also that the petitioner is languishing in jail custody since 07.10.2015, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Paharpur P.S. Case No. 278 of 2015.
