Petitioner seeks bail in Barh P.S.Case No.403 of 2014 registered under Sections 366, 420, 419, 376 of the IPC. The victim made allegation that the petitioner took her to a Hotel at Barh on the pretext of providing job in the College and committed rape with her.

It is submitted that the victim made her statement under Section 164 Cr.P.C. but she made contradictory statement about her age and address. The doctor found no sign of rape. The victim is major girl.

It appears that the victim has made specific allegation that the petitioner took her to Barh on the pretext of providing her a job in a College and committed rape with her in the Hotel. The victim lodged the case on the same day but she was examined by the doctor on the next day. The victim reiterated the same facts in her statement recorded under section 164 Cr.P.C.

Patna High Court Cr.Misc. No.9413 of 2015 (3) dt.24-04-2015 2/2 Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge he petitioner on bail and accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt or production of a copy of this order.
