Petitioner apprehends his arrest in Supaul P.S. Case No.322 of 2017 under Sections 363 and 366A/34 of the Indian Penal Code.
The mother of the victim named Sarwan Sah, Ravi Sah, Brahmanand Sah, Chaturanand Sah, Bimla Devi, Sulekha Devi and Atmaram and alleged lthat they all kidnapped her daughter to solemnize marriage with Sarwan Sah. Informant further alleged that petitioner Hira Lal Sah, the uncle of Sarwan Sah had concealed Sarwan Sah and her daughter.
Learned counsel for the petitioner submits that the petitioner is the uncle of Sarwan Sah, who is alleged to have kidnapped the daughter of the informant. Petitioner has no manner
Patna High Court Cr.Misc. No.43811 of 2017 (2) dt.21-09-2017 2/2 of concern with Sarwan Sah. The informant is not an eye witness of the occurrence. The victim herself fled away along with Sarwan Sah and the informant falsely implicated the entire family members of Sarwan Sah.
Considering the facts aforesaid, petitioner above named, in the event of his arrest or surrender before the court below within four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.322 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
