====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL JUDGMENT Date : 21-01-2021 Heard learned counsel for the petitioner and learned counsel for the respondents.

The petitioner has approached this Court for the following reliefs:

"(i) Issuance of a writ in the nature of writ of mandamus directing the respondents to pay interest of 18% P/A on the death cum retirement benefit given to the petitioner of his late father namely Ramprit Singh who was traceless since 08.12.1996.

(ii) Issuance of a writ in the nature of writ of mandamus directing the

Patna High Court CWJC No.14121 of 2019 dt.21-01-2021 2/3 respondent to pay family pension to the petitioner of Rs. 59,437=97 which was calculated and informed to the petitioner as retiral dues of late Ramprit Singh by Bihar State Electricity Board vide letter No. 120 dated 15.04.2006 (Annexure-4).

(iii) Issuance of a writ in the nature o writ of mandamus directing the respondents to pay heavy compensation of the petitioner on account of mental agony and harassment in delay payment of retiral dues of late Ramprit Singh father of petitioner after 22 years of his traceless and might have multiply 20 time of retiral dues therefore 1 crore must be paid to petitioner as compensation amount due to deliberate latches on the part of respondents which was not paid earlier within time.

(iv) Issuance of a writ in the nature of writ of mandamus directing the respondents to pay remaining retiral dues of late Ramprit Singh (father of petitioner) with interest which is less of Rs. 2,421/- as calculation given by the respondents.

(v) Issuance of any other writ(s) or order(s) or direction(s) which may be deemed fit and proper in the facts and circumstances of the case."

Patna High Court CWJC No.14121 of 2019 dt.21-01-2021 3/3 Learned senior counsel for the respondents submits that all the payments which is claimed by the petitioner has already been made as per the calculation. He further submits that if the petitioner has any claim with regard to redressal of his grievance, he may be relegated to concerned authority to file a representation.

Considering the facts and circumstances of the case, this writ application is disposed of with a direction to the concerned/authority that if the petitioner files a representation along with a copy of this order before him, the same shall be considered in accordance with law and he would be obliged to pass a reasoned and speaking order within a period of three months from the date of filing of such representation. The concerned authority would be solely responsible for non-compliance of this order within the stipulated period, as aforesaid.

With the aforesaid direction, this writ application stands disposed of.
