The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution, it is a case of commission of murder so far informant husband by the unknown person. Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence as alleged in the F.I.R. That the petitioner has falsely been implicated in this case by the informant due to malafide intention. Petitioner was neither arrested on the spot nor any incriminating articles have been recovered from the possession of the petitioner. On the basis of confessional statement of other accused person,

Patna High Court CR. MISC. No.48153 of 2022(4) dt.06-02-2023 2/2 chargesheet has been submitted against the petitioner. Petitioner is languishing in judicial custody since 13.12.2021. Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dumra P.S. Case No. 476 of 2021, G. R. No. 4428 of 2021, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
