JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.10.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The informant's mobile and motorcycle were robbed. Name of the petitioner sprang up in the confession of co accused Braj Mohan Kumar alias Braj Mohan Sah.

Statement has been made in paragraph 7 of the petition that there is no recovery from the petitioner nor the petitioner has been put on test identification parade. It is further submitted that the co accused on whose confession the petitioner has been named, has been granted bail vide Cr. Misc. No. 43600 of 2013.

No.6538 of 2015 (2) dt.19-02-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Parihar P.S. Case No. 12 of 2013.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
