JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-06-2022 At the outset of argument, learned counsel for the petitioner seeks permission to withdraw the anticipatory bail petition of petitioner No.1, Ravi Kumar.

Prayer is allowed.

Anticipatory bail petition of petitioner No.1 is dismissed as withdrawn.

Heard learned counsel for the petitioner No.2 and the State.

Petitioner No.2 apprehends his arrest in a case registered for the offence punishable under Section 307 and some other allied Sectins of the Indian Penal Code and u/s 3⁄4 of Dian Act.

Patna High Court CR. MISC. No.57781 of 2021(3) dt.30-06-2022 2/2 Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no allegation of assault against petitioner No.2 and he has been made accused in this case on account of previous enmity.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner No.2, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Hilsa, Nalanda in connection with Hilsa PS case No. 571/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
