The petitioner seeks bail in connection with Special Case No.2641 of 2021 arising out of Barh P. S. Case No.144 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 414 litre of liquor from an old house of petitioner.

The learned counsel for the petitioner submits that the old house is merely an abandoned house and is a joint family

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.2641 of 2021 arising out of Barh P. S. Case No.144 of 2021.

The application stands allowed.
