JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Sessions Trial No. 374 of 2015 arising out of Rosera P.S. Case No. 301 of 2014 registered under sections 364(A) of the I.P.C. pending in the Court of Additional Sessions Judge, Rosera at Samastipur.

The accusation is of kidnapping of the grandson of the informant by the petitioner making demand of ransom Rs. 5 lakh for his release.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the case diary that the petitioner was apprehended by the Police with the victim

No.2673 of 2016 (3) dt.17-03-2016 2/2 Himanshu Ranjan @ Vishal Kumar, grandson of the informant but no ransom was paid to the petitioner as alleged to be made by the petitioner. Moreover, petitioner is in relation of the informant's family and is in custody since 03.10.2014.

On the other hand, learned A.P.P. opposed the prayer of the petitioner with submission that the victim in his statement under Section 164 Cr. P.C. has supported the prosecution case regarding his kidnapping by the petitioner and making demand of Rs. 5 Lakh to his father as ransom. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
