JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but according to prosecution case itself, it was co-accused Seth Yadav, who gave Khanti blow, causing injury on the head of the deceased.
No doubt, there is allegation against petitioner No. 1 that she assaulted the deceased with brick but it has not been mentioned as to on which part, petitioner No. 1 caused injury to the deceased.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking
Patna High Court Cr.Misc. No.2951 of 2016 (2) dt.01-02-2016 note of this fact that petitioners are ladies and they are languishing in jail custody since long, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Gurua P.S. Case No. 173 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghatti, District-Gaya.
