The petitioner apprehends his arrest in Naubatpur P.S. Case No. 89 of 2017 under Section 393 of the Indian Penal Code.

The informant alleged that while he was returning from Danapur Civil Court, four persons assaulted him in order to commit robbery, but, on alarm accused persons fled away. Chandan Kumar was apprehended and one motorcycle was also recovered. Chandan Kumar, the co-accused, disclosed the name of the petitioner. It is, further, submitted that the owner of the motorcycle is the father of the petitioner. During the course of investigation, it has come that the father of the petitioner gave motorcycle to Chandan Kumar. But, it appears that Chandan Kumar, who was apprehended at the spot, disclosed before the villagers that the petitioner was also accompanying him along with other accused persons, who made attempt to commit robbery. Considering the nature of allegation, made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
