JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel for the informant. The petitioner seeks bail in a case registered under Section 406 and other sections of the Indian Penal Code and Section 138 of the N.I. Act.

The petitioner and the informant are businessmen and during the course of business transactions, the petitioner gave cheques for payment of money. The informant alleged that out of Rs. 35,00,000/-, only Rs. 10,00,000/- was paid and Rs. 25,00,000/- is still lying due against the petitioner.

Considering the facts aforesaid that during the business transactions the dispute arose between the informant and the petitioner for payment or non-payment of dues, the above named petitioner is directed to be enlarged on bail in Motihari (Town) P.S. Case No. 714 of 2014 on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.7185 of 2015 (2) dt.23-02-2015 2/2 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
