JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two cartridges and one motorcycle are said to have recovered from conscious possession of the petitioner when petitioner along with others had assembled for preparation of committing dacoity.

Learned counsel for the petitioner submits that petitioner is owner of seized motorcycle and so far as recovery of cartridges is concerned, the same is nothing but only highhandedness of the police for which petitioner is in jail custody since long without having any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.2633 of 2016 (2) dt.29-01-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mohd. Inam Kha, J.M.1st Class, Patna in connection with Digha P.S. Case No.306 of 2015.
