JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that four prosecution witnesses have already been examined and the trial court has sought six months' time to dispose of Sessions Trial No. 185 of 2012 arising out of Bihiya P.S. Case No. 143 of 2011. Learned counsel, appearing for the informant informs this court that only three prosecution witnesses have been left to be examined and, assures this court that the remaining prosecution witnesses shall be produced before the trial court as early as possible.

In view of the aforesaid submissions as well as taking note of allegation, levelled against the petitioner, I am not inclined

Patna High Court Cr.Misc. No.3582 of 2016 (3) dt.16-03-2016 2/2 to release the petitioner on bail and accordingly, his prayer for bail in connection with Sessions Trial No. 185 of 2012 arising out of Bihiya P.S. Case No. 143 of 2011 is, again rejected. However, learned trial court is directed to conclude Sessions Trial No. 185 of 2012 arising out of Bihiya P.S. Case No. 143 of 2011 within three months from the date of receipt/production of copy of this order, failing which, the petitioner may renew his prayer for bail before the learned trial court itself.
