2. The petitioner apprehends his arrest in connection with Maner P.S. Case No. 128 of 2024 registered for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code and under Section 9/10 of the Child Marriage and POCSO Act.
3. As per the prosecution case, the petitioner is accused of abducting the victim.
4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that from the
Patna High Court CR. MISC. No.51015 of 2025(3) dt.13-11-2025 2/2 record it will appear that the petitioner and the victim have married and even if the allegations are taken to be true, the victim is approaching 18 years of age as her date of birth in aadhar card is 1.1.2005 and therefore, the petitioner may be granted anticipatory bail.
5. Considering the aforesaid facts, this application is allowed.
6. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Exclusive, Patna-cum-ADJ, VII, Patna/concerned Court below in connection with Maner P.S. Case No. 128 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS. (Sandeep Kumar, J) Vikas/- U
