JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2016 Heard learned counsel for the petitioner as well as learned counsel appearing for the Vigilance.

Petitioner seeks bail in a case registered for the offences punishable under Sections 7/13(2) read with Section 13(1) D of Prevention of Corruption Act, 1988. Petitioner was working as Circle Officer at the relevant time and allegedly, he was caught red handed taking bribe of Rs. 20,000/-. The trial court has reported that charge sheet against the petitioner has already been submitted and the matter is pending for taking cognizance.

The above stated report of trial court is of dated 23.11.2016.

Patna High Court Cr.Misc. No.40380 of 2016 (4) dt.30-11-2016 2/2 Learned counsel for the petitioner submits that charge sheet against the petitioner was submitted sometime in the month of August 2016 but up till now cognizance has not been taken and, therefore, the remand of the petitioner appears to be illegal.

Be that as it may, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance North Bihar, Muzaffarpur in connection with Special Case No. 28 of 2016 arising out of Vigilance P.S.
