The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 307, 324, 325, 354, 323, 341, 447, 147, 379 of the Indian Penal Code and 27 of the Arms Act.

Learned senior counsel for the petitioners seeks permission to withdraw this application against petitioner no.3. Accordingly, this application is dismissed as

Allegation against the petitioners alongwith other accused persons is said to have assaulted the informant and his family members.

It has been submitted by learned senior counsel for the petitioners that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. The injuries are simple in nature except petitioner no.3 who has assaulted the victim by means of rod on the head and the injury is grievous in nature, who has withdrawn this application.

Learned APP for the State vehemently opposes the prayer for bail application.

In the aforesaid facts and circumstances of the case, let the petitioners except petitioner no.3, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court, in connection with Dawath P.S. Case No. 36/2020, subject to the conditions as laid
