2. The petitioner has preferred this application for grant of regular bail in connection with Maranga P.S. Case No. 22 of 2025 dated 29.01.2025 registered for the offences punishable u/ss 310(4), 310(5) and 111 of the B.N.S. and Sections 25(1-B)(a), 26 and 37 of the Arms Act.
3. As per the prosecution case, the informant received a secret information that some unknown persons have assembled to make preparations for committing crime. On which the informant along with the police personnel reached the place of occurrence. On seeing police, five to six persons along the roadside tried to flee away, out of which three persons were
Patna High Court CR. MISC. No.47341 of 2025(2) dt.24-09-2025 2/3 apprehended and they disclosed their name as Suman Kumar Yadav (petitioner), Md. Rahmat and Bijali Nadaf. On search, one loaded local made katta, three live cartrdges and two keypad mobile phone were recovered from the possession of the petitioner. One smart phone was recovered from the possession of the co-accused, Md. Rahmat. One mobile phone was also recovered from the possession of the co-accused, Bijali Nadaf.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner have no concern with the alleged offence. The petitioner has 13 criminal antecedents and he is on bail in 12 criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 09.01.2025. The co-accused persons have already been granted regular bail by this Court vide order dated 14.05.2025 passed in Cr. Misc. No. 28453 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.47341 of 2025(2) dt.24-09-2025 3/3 named, is directed to be enlarged on bail on furnishing bailbond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Maranga P.S. Case No. 22 of 2025, with following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
