====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-12-2021 Heard learned counsel for the petitioner, informant and learned APP for the State.
Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under
Patna High Court CR. MISC. No.4550 of 2021(5) dt.06-12-2021 2/3 Sections 341, 323, 379, 498(A), 307/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The petitioner is husband of the informant/O.P. No. 2.
The prosecution case relates to the harassment and cruelty due to non-fulfillment of the dowry demand of Rs. 2,00,000/-. The further case of the prosecution is that the husband put rope on her neck and started pulling, as a result of which, she sustained injuries. From perusal of the case diary as well as the impugned order, it appears that the informant sustained abrasion on neck measuring 3 x 1⁄4 cm on left side of neck and abrasion on right side of neck measuring 2 1⁄4 cm.
This Court does not find a fit case for consideration of anticipatory bail of the petitioner. The prayer for anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender before
Patna High Court CR. MISC. No.4550 of 2021(5) dt.06-12-2021 3/3 learned Court below within a period of four weeks from today and pray for regular bail which may be decided by the learned Court below without being prejudiced by the order of this Court.
With the aforesaid observation/direction, the petition stands disposed off.
