2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(b)/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, all the F.I.R. named accused persons committed murder of the father of the informant.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and as per informant, who claims to the eye witness of the occurrence, all the named accused persons committed the offence. Name of the petitioner transpired during course of investigation and there is no direct or indirect material to show his complicity in the present case.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.48637 of 2023(3) dt.22-08-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai in connection with Nayagaon P. S. Case No. 75 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
