JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 08.09.2015 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.
According to the prosecution case itself, petitioner happens to be elder brother-in-law of the informant and alleged occurrence took place on account of family feud. It is alleged that the petitioner sprinkled acid causing injury to the informant and two others including a minor girl.
Petitioner is in jail custody since 15.6.2014 and investigation of this case has already been completed but from perusal of para 78 of the case diary, I find that charge sheet against the petitioner was submitted on 8.4.2014 keeping investigation pending against rest accused persons and furthermore, para 48 of the supplementary case diary reveals that rest accused persons are charge
Patna High Court Cr.Misc. No.12239 of 2015 (4) dt.08-09-2015 sheeted and investigation of this case was kept pending against some of the accused persons but till submission of supplementary charge sheet, I.O. could not collect complete injury reports of injured persons of this case and, therefore, up till now, prosecution could not succeed to bring nature of the injuries sustained by injured persons of this case before the court.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K.Mishra, Judicial Magistrate, Ist Class, Sikrahana at Motiharij/ concerned court in Ghorasahan P.S. Case no. 56/2014.
