The petitioner seeks bail in Isuapur P.S. Case No. 31 of 2019, instituted for the offence under Section(s) 30, 38 and 41 of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that petitioner has not been apprehended on the spot.

It is alleged in the written report that one truck was seized by the Police from which 4,000 litres of spirit have been recovered. The villagers disclosed that petitioner was driver of the aforesaid truck.

Petitioner is in custody since 17.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.44307 of 2019(2) dt.22-07-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned XIth A.D.J. - cum Special Judge, Excise, Saran, in connection with Isuapur P.S. Case No. 31 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
