The petitioner apprehend his arrest in connection with Khaira P.S. Case No. 136 of 2016, registered under Sections 392 and 395 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate-10th, Saran, Chapra. The allegation of informant Prithvi Nath Chaurasia is that on 24.08.2016 at 8.00 P.M. he along with his son Mukesh Chourashia was going to his village boarding on motorcycle. In the way, six persons boarded on two motorcycles surrounded his motorcycle and snatched cash of Rs. 2500/-, Mobile, purse and I.D. Card etc. The informant detailed the physic of the miscreants and claimed to identify them.

Learned counsel for the petitioner submits that it

Patna High Court Cr.Misc. No.47360 of 2017 (2) dt.10-10-2017 2/2 would appear from the F.I.R. that the petitioner is not named in the F.I.R. and his name is surfaced on the confessional statement of co-accused.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. (Rajendra Kumar Mishra, J) manish/- U T
