JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 24.06.2014 in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 504, 302 and 328 of the Indian Penal Code.

It is alleged that all the accused persons including the petitioners assaulted the husband of the informant and put some poisonous substance in his mouth who subsequently succumbed to the injuries.

It is submitted by learned counsel for the petitioners that the occurrence is of 31.05.2014 when the postmortem was conducted on 01.06.2014 and the doctor opined that the injuries

Patna High Court Cr.Misc. No.7479 of 2015 (2) dt.02-03-2015 2/2 found on the body of the deceased are caused five days prior to the date of conduction of the postmortem. With similarly situated accused persons have been granted bail by this Court vide Cr. Misc. No. 5792 of 2015 and 45671 of 2014. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bagaha, West Champaran in connection with Laukariya P.S. Case No. 47 of 2014.
