This writ application has been filed by the petitioner for a direction to the respondent to consider the case of petitioner for compassion appointment. Father of the petitioner died in harness on 19.10.2015.
Learned counsel for the petitioner submitted that the petitioner has filed appropriate application in the prescribed format but the case of the petitioner was not considered for compassionate appointment. He further submitted that petitioner has filed representation for consideration of his case for
Patna High Court CWJC No.3774 of 2018 (2) dt.23-03-2018 2/2 compassionate appointment vide Annexure-5. Learned counsel in the aforesaid circumstances submitted that respondent may be directed to dispose of the representation dated 27.05.2017 which is pending before the respondent No.3, the District Magistrate-cumChairman, District Compassionate Appointment Committee. Compassionate appointment is provided to the family of the deceased employee to tide over the financial hardship occasion on the untimely death of bread earner. Therefore, the respondents are directed to take final decision on the claim of petitioner who is dependent of employee died in harness at the earliest. Since the representation is pending before the respondent No.3, in the said circumstances, the respondent No.3 is directed to dispose of the representation within 60 days from the date of production of a copy of this order.
If petitioner is found entitled for consideration and grant of compassionate appointment, necessary decision in this regard may be taken by the respondent authority within time framed quoted hereinabove.
