JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Petitioners being wife, father-in-law and brother-in-law of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 324, 326, 307, 379, 34 of the Indian Penal Code. The prosecution case is that petitioner No. 1 in pursuance to the Court's order came to the matrimonial house and thereafter petitioner Nos. 2 and 3 came to the informant's house and started taking away petitioner No. 1 when co-accused Deepak Kumar threw some chemical on the body of the informant which caused injuries.
It is submitted by learned counsel for the petitioners that since petitioner No. 1 earlier filed a case alleging accusation under Section 498A I.P.C and informant was not ready to keep her in the matrimonial house, hence the present case has been lodged. The informant suggested
Patna High Court Cr.Misc. No.3404 of 2016 (2) dt.21-01-2016 2/2 chemical burn injury on the back of the neck and the lower portion of the body but no size of the injury has been mentioned when the accusation of pouring chemical is against Deepak Kumar who is not petitioner before this Court. Considering the nature of accusation in the background of earlier case filed by petitioner No. 1 and the thrust of accusation of pouring chemical against Dilip Kumar, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 188 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
