2. The petitioner apprehends his arrest in connection with Sheikhpura (Hathiyawa O.P.) P.S. Case No. 140 of 2022 registered for the offence punishable under Sections 419, 420, 467, 468, 471, 506 / 34 of the Indian Penal Code.
3. As per the prosecution case, the informant handed over his truck to the accused persons after getting Rs. 4,00,000/- cash by co-accused Chhotu Kumar and he also gave cheque of Rs. 2,81,000/- to the informant but the said cheque was dishonoured. The only allegation against the petitioner is that he accompanied co-accused Md. Sayied and Chhotu Kumar.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.50044 of 2023(2) dt.11-08-2023 2/2 petitioner is innocent and has falsely been implicated in this case. No transaction has been done between the informant and the petitioner. The petitioner has no criminal antecedent. The petitioner has no concern with Md. Sayied and Chhotu Kumar
5. Learned A.P.P. opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of his arrest or surrender before the Court below within six weeks from today, the above named petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Hathiyawa O.P.) P.S. Case No. 140 of 2022 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
