JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2017 Heard the learned counsel for the petitioner and learned APP for the State.

This application has been filed for modification of the order dated 10.08.2017. Earlier the prayer for bail of the petitioner was allowed by this Court vide order dated 10.08.2017 in Criminal Miscellaneous No. 36408 of 2017 and a period of four weeks was granted to him for surrender before the learned court below. It has been submitted on behalf of the petitioner that pairvikar of this case could not inform the petitioner within the time limit as he was in Haryana to earn his livelihood and, as such, he could not surrender within the time.

In view of the facts and circumstances of the case, two weeks time from receipt of order, is granted to the petitioner to surrender before the court below and pray for regular bail. The court below shall consider his prayer for bail taking into the consideration the fact that the petitioner was earlier granted anticipatory bail by this court.
