The petitioner has renewed his prayer for bail in connection with Sour Bazar P.S.Case No.120 of 2014 registered for the offences punishable under sections 25(1-B)(a) and 26 of the Arms Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 10th October, 2014 passed in Cr.Misc. No. 33042 of 2014 with the following observations :- "The Chief Judicial Magistrate, Saharsa is directed to expedite the trial and conclude the same as early as possible preferably within five months from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to renew his prayer for bail."
Patna High Court Cr.Misc. No.14629 of 2015 (2) dt.15-04-2015 2/2 It has been contended that though the petitioner is in custody since 16th April, 2014 but till date only one out of seven witnesses could be examined on behalf of the prosecution in course of trial.
Regard being had to the observations made in the order dated 10th October, 2014 passed in Cr.Misc. No. 33042 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.K.Singh, Judicial Magistrate 1st Class, Saharsa in connection with Sour Bazar P.S.Case No. 120 of 2014.
