The petitioner apprehends his arrest in connection with Awtarnagar P.S. Case No. 246 of 2020 registered under Section 30(a) of the Bihar Excise and Prohibition Act pending in the Court of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no criminal antecedent. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. On perusal of

Patna High Court CR. MISC. No.2707 of 2021(2) dt.15-11-2021 2/2 seizure list, it appears that illicit liquor has been recovered from the Palani of the petitioners. Hence, this is not a fit case for anticipatory bail.

Having considered the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) shailendra/- U T
