The petitioner seeks bail in Dumaraon P.S. Case No. 150 of 2013 dated 26.07.2013 instituted under Sections 302/307/34/120B of the Indian Penal Code and 27 of the Arms Act.

This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order 27.06.2014 in Cr. Misc. No. 11354 of 2014.

Nothing has been brought on record or to the notice of the Court by way of intervening circumstances to justify or constitute any fresh ground for grant of bail to the petitioner. Accordingly, the Court is not inclined to enlarge the petitioner on bail and the application stands dismissed. However, keeping in view the fact that the petitioner is in custody since 25.12.2013, the Court below is

Patna High Court Cr.Misc. No.9582 of 2015 dt.12-04-2016 2/2 directed to expedite the trial and conclude the same positively within nine months.

The Superintendent of Police, Buxar is directed to ensure that witnesses are produced before the Court on the dates fixed. It shall be the responsibility of the trial Court to ensure that the direction of this Court is complied with within time. Registry shall communicate the order of the Court below as well as the Superintendent of Police, Buxar by Fax also latest by tomorrow.
